DRConsultancy Limited and you

1.DEFINITIONS

These Terms and Conditions govern the provision of services by DRConsultancy Limited, an energy consultancy firm. References to “we”, “us”, and “our” shall be deemed to be references to DRConsultancy. References to “client”, “you”, and “your” shall be deemed to be references to the individual, company, partnership or organisation issuing the instruction to use Our services.

“EPC Assessor” means an accredited EPC Assessor.

“The property” means the premises, being a building as having a requirement for an Energy Performance Certificate (EPC) and/or retrofit Assessment

“Inspection/Assessment” means the study of the property which contribute to the creation of an EPC or retrofit assessment/design carried out by the EPC assessor/retrofit assessor.

“EPC” means Energy Performance Certificate, official document produced by computer software as determined by the UK government.

“Fee” “Payment” means the amount in pound sterling agreed to be paid by the client to DRConsultancy. This fee is agreed prior to inspection and will be inclusive of VAT.

“Services” means the supply of services to you, including but not limited to reports and photographs.

By engaging our services, you agree to be bound by the terms set out herein.

2.    SERVICES PROVIDED

We provide the following services:

  • Energy Performance Surveys (including EPCs)
  • Retrofit Assessments (in accordance with PAS 2035 standards)
  • Retrofit Design
  • Retrofit Coordination and Project Management
    1.        Provide accurate, complete, and timely information required to perform the services.

Additional services may be agreed upon in writing.

3.             CLIENT RESPONSIBILTIES

You agree to:

  1.       Grant us or our subcontractors’ access to the property as reasonably required.
  2.       Obtain all necessary permissions where applicable.

 

4.             PLACING AN ORDER

4.1          By placing an order with us you will be deemed to have read, understood and agreed to these Terms and conditions. 4.2          By placing an order you are making an offer to DRConsultancy Limited to instruct our services, the agreement between Us shall come into existence when We receive the request by whatever means.

5.             FEES AND PAYMENT

5.1          All services are provided as per the agreed schedule. Anything outside the scope will be priced individually.

5.2          Invoices are payable within 30 days from the date of issue unless agreed otherwise.

5.3          We reserve the right to charge interest on overdue invoices at a rate of 8% per annum above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

5.4          We will send invoices to the email address you provided. 
 

5.5          The method of payment will be via Bank transfer to our account.

6. CANCELLATION

6.1          We reserve the right to reschedule services due to unforeseen circumstances and will provide reasonable notice where possible.

7.             STANDARDS AND COMPLIANCE

7.1          All retrofit services are carried out in line with the current PAS 2035 framework and other relevant industry standards.

7.2          All surveyors are fully qualified and certified to carry out their specific role as requested.

7.3          We do not guarantee specific outcomes or savings unless explicitly agreed in writing.

8.             LIABILITY

8.1          We hold public liability of £2 million and professional indemnity insurance to the value of £250,000.

8.3          Nothing in these terms’ limits liability for death or personal injury caused by negligence or for fraud.

9.             INTELLECTUAL PROPERTY

9.1          The Client confirms that the Surveyor has the right within the property to take measurements; make diagrams; take photos; and make such notes which are believed to be necessary for the inspection. That such documents, photos, etc are for the sole use of the client. Such documents are made by the surveyor as required by UK law, and the Surveyor is required to retain such documents by Law. DRConsultancy & the Surveyor confirms they will safely and securely dispose and destroy all such documents and will not communicate to any third party who does not have a legal right to them.

10.          CONFIDENTIALITY

10.1       Both parties agree to maintain confidentiality over all proprietary and sensitive information disclosed during the course of the services.

11.          SUBCONTRACTING

11.1       We reserve the right to subcontract any part of the services, provided all work meets our quality and compliance standards.

12.          FORCE MAJEURE

12.1       We shall not be liable for any delay or failure to perform due to circumstances beyond our
              reasonable control including, but not limited to, weather conditions, illness, or government 
              restrictions.

13.          GOVERNING LAW

13.1       These Terms and Conditions shall be governed by and construed in accordance with the laws
              of [England and Wales], and any disputes shall be subject to the exclusive jurisdiction of the 
               courts of [England and Wales].

14.          AMENDMENTS

14.1       We reserve the right to amend these Terms and Conditions at any time. Clients will be notified 
               of any material changes in writing.

15.          COMPLAINTS

15.1       A complaint with the service provided by DRConsultancy Services Ltd must follow our 
Complaints Procedure which can be found on our website www.drconsultancy.co.uk under “Feedback”.
